ToolClerk (“we,” “us,” or “our”) is operated by Welch Digital. This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use the ToolClerk mobile application (the “App”) and related services (collectively, the “Service”).
By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this policy, please do not use the Service.
1. Information We Collect
1.1 Information You Provide
When you create an account or use the Service, you may provide us with:
- Name and contact information (email address, phone number)
- Account credentials (username, password)
- Company or organization name
- Tool inventory data (tool descriptions, serial numbers, photos, assigned personnel)
- Any other information you choose to provide
1.2 Information Collected Automatically
When you use the App, we may automatically collect:
- Device information (device model, operating system, unique device identifiers)
- Usage data (features accessed, actions taken, timestamps)
- Log data (IP address, browser type, referring pages, crash reports)
1.3 Location Data (Future Feature)
In a future release (Phase 2), the App may collect precise geolocation data (GPS coordinates) to enable tool-location tracking features. Location data will only be collected with your explicit, informed consent. You will be prompted to grant location permissions before any GPS data is gathered, and you may revoke that consent at any time through your device settings. Location tracking will never be enabled silently or by default.

We use the information we collect to:
- Provide, maintain, and improve the Service
- Create and manage your account
- Enable tool tracking, assignment, and inventory management
- Send you service-related notices and updates
- Respond to your requests, comments, or questions
- Monitor and analyze usage trends to improve user experience

3. How We Share Your Information
We do not sell your personal information. We may share your information in the following limited circumstances:
- Service Providers: With third-party vendors who perform services on our behalf (hosting, analytics, customer support), subject to confidentiality obligations.
- Within Your Organization: With other members of your team or organization as necessary to enable shared tool-tracking features.
- Legal Requirements: When required by law, legal process, or governmental request, or to protect the rights, property, or safety of ToolClerk, our users, or the public.
- Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, in which case your information may be transferred as part of that transaction.
4. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. We may also retain and use your information to comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we will delete or anonymize your personal data within a reasonable timeframe, except where retention is required by law.
5. Data Security
We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

6.2 Account Deletion
You may request deletion of your account and associated personal data by contacting us at support@toolclerk.app. We will process your request in accordance with applicable law.
6.3 Opt-Out of Communications
You may opt out of promotional emails by following the unsubscribe instructions in those messages. You will continue to receive transactional and service-related communications.
6.4 Location Permissions
If and when location features become available, you may enable or disable location permissions through your device's operating system settings at any time.
7. CalOPPA Compliance
In accordance with the California Online Privacy Protection Act (CalOPPA), we make the following disclosures:
- Users may visit the App without being required to reveal their identity, though account creation is required to use most features.
- This Privacy Policy is accessible via a conspicuous link on our marketing website and within the App.
- The effective date of this Privacy Policy is displayed at the top of this page.
- Changes to this Privacy Policy will be communicated by updating the effective date and, where appropriate, notifying you via email or in-app notification.
- We honor Do Not Track (DNT) browser signals. When we detect a DNT signal, we do not track your activity across third-party websites.
- Third parties are not permitted to collect personally identifiable information about your online activities over time and across different websites when you use our Service.
8. Children's Privacy
The Service is not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal data from a child under 16, we will take steps to delete that information promptly. If you believe a child under 16 has provided us with personal information, please contact us at support@toolclerk.app.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date at the top of this page and may notify you via the App or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised policy.
